I have no idea where this Prosser story will go - - though a "he was provoked" defense by talk radio Monday won't shock me - - but remember that the Governor gets to fill a State Supreme Court vacancy, and Walker would pick someone from the Gableman wing of the legal profession.
Justices David Prosser and Michael Gableman have their hands on the Court's right-steering ideological and electoral rudder, and their careers as Justices make up a case study in mutual aid.
When Gableman was facing an ethics case after his contentious 2008 defeat of liberal incumbent Justice Louis Butler, Prosser helped have the case dropped by a split Court.
Gableman then campaigned on the stump for Presser this year, and received lavish thanks after Prosser's election.

Prosser won't resign He needs to be recalled and have someone run against him. Then again, if it gets to a recall he may indeed resign. Bummer!
That would be another year and after other recalls. That's a lot to think about.
Even if Prosser was legitimately angry (though it does seem he has a low boiling point), the fact remains that he assaulted Justice Bradley in her office, and nothing was preventing him from standing up and walking out the door.
If an ordinary (non Supreme) being grabbed the throat of a co-worker, HR would not let the incident pass; and there's a good chance he would be walking out of the office in handcuffs.

I don't think that's right. An appointed justice must stand for election in the first spring following in which no other justice's term expires, and none expire in 2012.
Louis Butler got a pass because there were elections in '05, '06 and '07.
How about we convict the guy and ask him to resign before we know what, if anything actually happened.
In supreme irony, Prosser is now all for "a proper review of the matter and the facts surrounding it."

Why do these guys seem to hate women so much? Why do they fly off the handle so much? Where is the vaunted 'judicial temperament?' These shouting matches that result in physical contact, violent or not, is shameful behavior for people who are supposed to be making judicious, carefully reasoned rulings on legal issues that have consequences for other people's lives.
as i understand it, if a Supreme Court Justice resigns the Gov appoints a "temporary" replacement to serve until someone is elected to a full 10 year term. If the vacancy occurs on or before Dec 1, 2011, then an election for a full term would be held at the 2012 Spring Election.
