New Sotomayor Problem: Too Much Danged Scholarship

Apparently this brand of activist insists on producing opinions that are just too darned detailed.

It seems she studies and reads and does all sorts of brainiac things that judges shouldn't be doing.

Couldn't Obama have found a nominee more like that wacky word warrior and thinkifier George W. Bush?

There are so many problems with that article it's hard to say where to begin.

One thing is fairly safe to say without delving into the cases -- none of which are named, as is typical for legal reporting in the press -- and that is that in light of several recent Supreme Court cases and much scholarship, Sotomayor was prescient in her concerns over the federal sentencing guidelines.
