I Suppose The Right Will Withhold Criticism Of This Federal Judge

The Right has condemned activist (sic) Federal judges who overturned California's gay marriage ban and Arizona's immigration enforcement state law - - and attacked the Constitutional separation of powers that gives courts the duty and power to review government action - - but I am sure they will applaud this Federal judge's decision to block the Obama administration's stem cell policies.

A true constitutionalist accepts and understands judicial review; the Right's situational and selective attacks on the judiciary are simply another strain of political correctness.

  1. That their is a federal law against Obama's policy wouldn't have factored into the decision?

  2. James,

That kind of is the point. An executive cannot simply ignore what the law says.

If you don't like it, change the law.

This is what is happening against AZ and immigration. They are enforcing federal law, but the feds don't like it because AZ is doing what they are refusing.

It won't make it unlawful in the end, but that doesn't mean the adminstration can simply ignore the law or try to stop other from enforcing it.

  3. what the law says

The law says federal funds can't be used in research that destroys embryos. This judge says the law also covers research that relies on prior research that destroyed embryos.

That's an insane interpretation of Congress' intent. Even if one thinks the former kind of research is tantamount to, say, the Tuskegee experiments, no one would say a cure for syphilis based on information from those experiments should be banned.

  4. Rowen decrying "political correctness" . . .

That is the funniest thing I have seen in a very long time.

Question for you James, does a fish know it is wet?

  5. To Anonymous: Both sides have their own political correctness. Usually you hear only the Right attacking liberals for it.
